The legal basis for development of standardization system in Montenegro, as well as for the establishment and operating of an independent and non-profit national organization for standardization, is established by the Law on Standardization ("Official Gazette of Montenegro", No. 13/08), by Decision on the Establishment of the Institute ("Official Gazette of the Republic of Montenegro", No. 21/07) and by the Statute of the Institute for Standardization of Montenegro ("Official Gazette of Montenegro", No. 29/08, 057/19). The Decision on the establishment of the Institute for Standardization of Montenegro was replaced by the Decision on the Organization of the Institute for Standardization of Montenegro ("Official Gazette of Montenegro", No. 087/22 of 04.08.2022), which is harmonized with the current Law on Standardization.
Law on Standardization regulates: principles and goals of standardization in Montenegro, establishment, structure and activity of the standardization organization of Montenegro, adoption, issuance and implementation of Montenegrin standards and standardization related documents, as well as supervision over the implementation of this law.
The Government of Montenegro, by the Decree on the Establishment of the Institute for Standardization of Montenegro, established the Institute for Standardization of Montenegro to achieve the goals of standardization and the adoption of Montenegrin standards and related documents.
The decree regulates the name and seat of the Institute, activity, membership in the Institute, bodies, financing, rights, obligations and responsibilities of the Institute in legal transactions, as well as supervision over the work of the Institute.
At the session of July 18, 2022, the Government of Montenegro passed the Decision on the organization of the Institute for Standardization of Montenegro ("Official Gazette of Montenegro", No. 087/22 of August 4, 2022). This decision stipulates that ISME is organized and performs its activities as the Institute for Standardization of Montenegro in accordance with the Law on Standardization ("Official Gazette of Montenegro", No. 145/21).
The Statute of the Institute for Standardization of Montenegro closely regulates: name and headquarters of the Institute, seal and stamp, logo, activity of the Institute, rights, obligations and responsibilities in legal transactions, representation in legal transactions, business secrecy, informing public about work of the Institute, financing, closer organization of the Institute, models of acquiring and terminating membership in the Institute, models of participation of Institute’s members in its work, ways of determining and paying membership fees, models of electing members for Institute’s Assembly, bodies of the Institute, scope of responsibilities of the Institute bodies and decision-making procedures, Institute’s general documents and other matters relevant for the work of the Institute.
